These Terms of Service govern your use of the Pelvic Floor Exercise website and any purchases made through it.

 

The website is operated by PFLEX HEALTH PTY LIMITED (ABN 18 689 582 072), trading as Pelvic Floor Exercise. In these Terms, “we,” “us” and “our” refer to PFLEX HEALTH PTY LIMITED.

 

By using this website or placing an order, you agree to these Terms. If you do not agree, please do not use the website.

2.   Eligibility

 

You must be at least 18 years old, or otherwise legally capable of entering into a contract, to place an order through this website.

 

If you place an order for another person or organisation, you confirm that you have authority to act on their behalf.

 

Certain products, pricing or resources may be available only to verified healthcare professionals or approved wholesale customers. We may request evidence of professional registration or other eligibility before approving access.

3.   Website information

 

We aim to ensure that product descriptions, prices, images, stock information and other website content are accurate and current.

 

Occasionally, information may contain an error or become outdated. We will endevour  to correct errors and update website content when required. If an error affects an order you have placed, we will contact you and offer an appropriate solution, which may include proceeding with corrected information or cancelling the affected item for a refund.

 

Product images are provided as a guide. Packaging, colours and product presentation may change without notice, provided the product supplied remains consistent with its description.

 

 

4.   Health and product information

 

Information provided on this website is general educational and product information. It is not medical advice and does not replace diagnosis, treatment or personalised advice from a qualified health professional.

 

Pelvic health conditions and individual needs vary. If you are uncertain about your symptoms, treatment or whether a product is appropriate for you, consult a pelvic health physiotherapist, continence nurse, doctor or another suitably qualified health professional.

 

Always read and follow the manufacturer’s instructions, warnings and intended use before using a product.

5.   Prices and GST

 

Unless otherwise stated:

• Prices are displayed in Australian dollars.
• Prices include GST where GST applies.
• Some eligible medical aids and appliances may be GST-free.
• Delivery charges are calculated and displayed during checkout.

 

Prices may change without notice, but a price change will not affect an order that we have already accepted.

 

If an obvious pricing error occurs, we may contact you before dispatch to confirm whether you wish to proceed at the correct price. If you do not wish to proceed, or we cannot contact you, the affected item will be cancelled and refunded.

 

 

6.   Placing and accepting orders

 

Submitting an order is an offer to purchase the selected products.

 

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted. An order is accepted when we confirm dispatch or otherwise expressly confirm acceptance.

 

We may decline or cancel an order before dispatch if:

• A product is unavailable.
• Website, stock or pricing information contains an error.
• Payment cannot be authorised.
• We cannot deliver to the supplied address.
• We reasonably suspect fraud or unauthorised activity.
• The order breaches these Terms or another applicable policy.
• Account payments are not current

 

If payment has already been taken for an order we cannot accept, we will issue a refund using the original payment method.

 

7.   Payments

 

Payment must be made using a payment method offered at checkout.

 

Payments are processed by the selected payment provider, which may include Shopify Payments, Stripe, Afterpay, PayPal or another displayed provider. Their separate terms and privacy practices may apply to the payment service they provide.

 

Pelvic Floor Exercise does not receive or store complete payment-card details.

Charges will appear on card statements as PFLEX Health Pty Ltd.

 

Healthcare-professional or wholesale customers with approved payment terms may be subject to additional account conditions.

 

 

8.   Delivery

 

Orders are dispatched from Australia by our team.

 

Delivery options, charges, tracking and estimated timeframes are described in our Shipping Policy and displayed at checkout where applicable.

 

Delivery timeframes are estimates rather than guarantees. If there is a material delay or delivery problem, contact us so we can investigate and assist.

 

For international orders, the recipient is responsible for any import duties, taxes or customs requirements imposed by the destination country unless otherwise stated.

 

 

9.   Returns, faults and consumer rights

 

Returns, exchanges and faulty products are handled in accordance with our Returns and Refunds Policy and the Australian Consumer Law.

 

Because some products are intimate or hygiene-sensitive, change-of-mind returns may be restricted where a product has been opened, used or had its hygiene seal removed. These restrictions do not affect your rights where a product is faulty, unsafe, incorrectly described or otherwise fails to meet a consumer guarantee.

 

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

 

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

 

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

10. Customer accounts

 

You are responsible for ensuring that information connected with your customer account is accurate and current.

 

You must not access another person’s account or allow your account to be used fraudulently or unlawfully. Contact us promptly if you believe your account or email access has been compromised.

 

We may suspend or restrict an account where reasonably necessary to investigate suspected fraud, misuse, security concerns or a breach of these Terms.

 

 

11. Healthcare-professional and wholesale accounts

 

Access to healthcare-professional or wholesale pricing may require approval and verification.

Applicants must provide accurate and current professional or business information. Access may be suspended or withdrawn if eligibility requirements are no longer met, information is inaccurate or the account is misused.

 

Additional payment, ordering or account terms may apply to approved professional and wholesale customers. Where additional terms apply, they will be provided separately.

 

 

12. Acceptable use

 

You must not use this website to:

• Break any applicable law.
• Commit or facilitate fraud.
• Interfere with the website’s security or operation.
• Introduce malicious software or harmful code.
• Attempt to access accounts, systems or information without authorisation.
• Collect information from the website using automated methods where this unreasonably affects the website or infringes our rights.
• Copy or commercially exploit website content without permission.

 

We may restrict access where reasonably necessary to protect the website, our customers or our business.

Website content created by or for Pelvic Floor Exercise, including original text, graphics, videos, educational resources and website design, is owned by or licensed to PFLEX HEALTH PTY LIMITED and is protected by applicable intellectual-property laws.

 

Some product descriptions, images, trademarks, instructions and other materials belong to manufacturers, suppliers or other third parties. Those materials remain the property of their respective owners.

 

You may view and use website content for personal, non-commercial purposes. You must not reproduce, modify, republish, sell or commercially exploit our content without written permission, except where permitted by law.

• Incorrect or incomplete information supplied by the customer.
• Unauthorised access resulting from a customer failing to protect their account or email access.
• Third-party websites or services outside our reasonable control.

 

Any limitation in these Terms applies only to the maximum extent permitted by law.

We handle personal information in accordance with our Privacy Policy.

 

By using the website, you acknowledge that information may be processed by Shopify and other service providers required to operate the store, process payments, deliver orders and provide customer service.

The current version will be published on this page with its effective date. Changes will not retrospectively alter the terms applying to an order we have already accepted unless required by law or agreed with you.

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws.
